Fayette County to pay up to Munchinski's attorney

Visiting Northumberland Judge Barry Feudale ruled yesterday that Fayette County should pay Munchinski attorney, Noah Geary, more than $123,000 for the six months he has gone without pay while representing Munchinski, reports the Pittsburgh Post Gazette.

The county argues that because Geary was chosen by Munchinski rather than court-appointed they should not have to pay his fees. However, Feudale pointed out that while Geary was not court-appointed the county never objected to his representation of Munchinski until they were asked to pay his fees.

Munchinski was given a new trial in October 2004. This decision was heavily based on information revealing prosecutorial misconduct by Fayette County prosecutors provided by Bill Moushey who runs the Innocence Institute of Point Park University.
